How does Xbox find one someone is using a modded xbox?

I took my xbox into a place to get in it modded (it was a software) anyway i didnt have live for 3 months but am planning on getting, the guy stated microsoft wont be able to detect unless i play a Game online that came out too early I played online before and months and never had trouble. Is it only the chips ones getting caught?

There is no way of knowing how they detect it as of yet. But it is happening to thousands of people whether or not they are playing games early online or not. Achievements are timestamped.
A modded console is not taken lightly by xbox. it is not the same as a modded controller, you actually modified xbox hardware and they consider it a federal offense.
It is not only the chipped ones being caught, it is anyone regardless of form of modification.
